Terms of Service

SPOT2WATER is a collaborative app for discovering, sharing and rating aquatic spots in Europe (lakes, rivers, waterfalls, beaches, springs, etc.). The service is published by MandySoft and accessible via the mobile app (iOS / Android) and the website spot2water.com.

By accessing the service or creating an account, you unconditionally accept these Terms of Service. If you do not accept these terms, you must stop using the service.

• ▸Registration is free and open to any individual aged 13 or over (16 for consent-based data processing in the EU).
• ▸You are responsible for the confidentiality of your credentials. Any use of your account is deemed to have been made by you.
• ▸You agree to provide accurate information when registering.
• ▸One account per person. Creating multiple accounts to circumvent moderation is prohibited.
• ▸MandySoft reserves the right to suspend or delete any account in violation of these Terms, without notice.

Users can contribute to the collaborative map by adding spots, reviews, ratings and photos. By publishing content, you agree to comply with the following rules:

• ▸Content must be relevant (a real aquatic spot, publicly accessible or with clearly indicated restricted access).
• ▸Geographic information must be accurate. Deliberately publishing incorrect coordinates is prohibited.
• ▸Strictly prohibited: hateful, discriminatory, sexual or violence-glorifying content, or content that infringes others' privacy.
• ▸Publishing personal data of third parties without their consent is prohibited.
• ▸Spam, fraudulent reviews and commercial self-promotion are prohibited.

By publishing a photo on SPOT2WATER, you declare and warrant that:

• ▸You are the author of the photo or hold an explicit licence authorising its publication (Creative Commons licence, rights assignment, written authorisation from the author).
• ▸The photo is free of third-party copyrights: it does not reproduce a protected work without authorisation (painting, architectural work, logo, etc.).
• ▸The photo does not depict an identifiable person without their express consent (right to image).
• ▸The photo does not depict a minor without the written consent of their legal representative.
• ▸The photo does not contain visible personal data (readable licence plates, addresses, etc.).
• ▸The photo is not AI-generated from protected works, or if it is, you hold the rights of use.

Moderation and reporting

• ▸MandySoft reserves the right to remove any photo without notice in case of violation of these Terms or a legitimate copyright claim.
• ▸Any user can report a problematic photo via the report button in the app or at info@spot2water.com. info@spot2water.com.
• ▸In the event of a copyright infringement claim (DMCA procedure), we will process the request within 72 hours.

All elements of SPOT2WATER (name, logo, design, source code, texts, database) are the exclusive property of MandySoft and are protected by intellectual property law.

Any unauthorised reproduction, representation, modification, adaptation or exploitation of these elements is prohibited and constitutes infringement punishable under intellectual property law.

User contributions (spots, reviews, photos) remain the intellectual property of their authors, subject to the licence granted to MandySoft described in Article 4.

• ▸Access to the basic service is free. The free version includes ads served by Google AdMob.
• ▸The SPOT2WATER Premium subscription is priced at €9.90 VAT incl. / year, automatically renewed.
• ▸The Premium subscription removes ads and unlocks advanced features (filters, etc.).
• ▸Payment is secured via Stripe. No banking data is stored on our servers.
• ▸You can cancel your subscription at any time from your profile. Premium access remains active until the end of the current period.
• ▸In accordance with consumer protection law, the 14-day right of withdrawal does not apply to digital content whose execution has begun, unless otherwise agreed.

• ▸Before visiting a spot, check local regulations (swimming bans, private property, weather conditions).
• ▸Swimming at certain spots may carry risks (currents, depth, cyanobacteria). MandySoft accepts no liability in case of accident.
• ▸Users are encouraged to report incorrect information or dangerous spots via the app.

It is in particular prohibited to use SPOT2WATER to:

• ▸Attempt to hack, decompile or compromise the security of the service.
• ▸Use bots, scripts or automated tools to scrape data without authorisation.
• ▸Publish false or misleading reviews, positive or negative, about spots.
• ▸Impersonate another user or MandySoft.
• ▸Use the service for unauthorised commercial purposes (unsolicited advertising, data resale).
• ▸Deliberately publish false coordinates or dangerous information about a spot.

MandySoft strives to ensure continuous service availability but cannot guarantee uninterrupted access. Interruptions for maintenance, updates or technical incidents may occur.

To the extent permitted by applicable law, MandySoft shall not be liable for indirect damages resulting from use or inability to use the service, information published by users, or decisions made based on data on the map.

• ▸MandySoft may suspend or delete an account in case of violation of these Terms, without notice or compensation.
• ▸To request account deletion, send an email to info@spot2water.com with the subject "Account deletion" from your account email address. The request will be processed within 30 days.
• ▸Account deletion results in the permanent loss of associated data. Published spots and reviews are anonymised.

These Terms are governed by French law. In the event of a dispute, an amicable solution will first be sought by contacting info@spot2water.com.

For unresolved disputes, the competent courts are those in the jurisdiction of MandySoft's registered office, unless otherwise required by consumer law. EU consumers may also use the Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

MandySoft reserves the right to modify these Terms and service pricing at any time and without notice. Changes take effect upon publication on the website.

Continued use of the service after any modification constitutes acceptance of the new terms and pricing. Users are responsible for regularly consulting this page. Active subscriptions are billed at the rate in effect at the time of subscription or renewal.
